Representation and Warranties
By submitting a model to ROMAN SKY COLLECTIVE, you represent and warrant that you are the sole owner of all rights in the submitted work or that you are fully authorized to grant the rights described below. You confirm that your submission is original and that no third‑party rights (including publicity, privacy, trademark, copyright, moral rights, or contractual rights) are infringed.
Originality and Non Identification
You guarantee that the submitted model does not intentionally replicate, impersonate, or materially resemble any identifiable real person, living or deceased, public figure, or celebrity. If your model is inspired by a real person, you must obtain and provide written, verifiable consent from that person before submission.
Rights and License Grant
You confirm you hold all necessary rights, clearances, and consents to license the submitted assets for commercial use. By listing with ROMAN SKY COLLECTIVE you grant ROMAN SKY COLLECTIVE a non‑exclusive, worldwide, transferable license to display, promote, and introduce the model to potential clients and partners for the purpose of booking and campaign placement, subject to agreed usage terms and any restrictions you provide.
Rights Attestation and Verification
You agree to complete a rights attestation during onboarding and to provide documentation on request (e.g., contracts, releases, provenance records). ROMAN SKY COLLECTIVE reserves the right to suspend or remove any listing pending verification or if credible claims of infringement or misrepresentation arise.
Indemnification and Liability
You agree to indemnify, defend and hold harmless ROMAN SKY COLLECTIVE, ROMAN SKY MEDIA GROUP and their affiliates from any claims, losses, damages, liabilities, costs and expenses (including reasonable legal fees) arising from your breach of these representations and warranties, or from any third‑party claim that the submitted content infringes rights or violates law. ROMAN SKY COLLECTIVE’s liability for any claim related to listings is limited to the extent permitted by applicable law.

I confirm that I am the owner or authorized rights holder of the submitted model; the work is original and does not materially resemble any identifiable real person; I have obtained all necessary consents and releases; and I agree to the ROMAN SKY COLLECTIVE terms, including verification and a 10% commission on confirmed bookings.
Additional Terms — AI Avatar
Programme (Build & Represent)
The following terms apply in addition to and where relevant override the sections above for creators who do not yet hold an existing AI model and instead commission ROMAN SKY COLLECTIVE to build their avatar through the Avatar Programme (tiers Debut €49, Signature €199, Iconic €499).Scope of the Programme
The AI Avatar Programme is a one-time production service combined with ongoing representation. Upon receipt of the applicable setup fee, ROMAN SKY COLLECTIVE produces a generative AI avatar based on the reference materials, persona description, and voice description you provide. The avatar is then listed on the ROMAN SKY COLLECTIVE roster and pitched to brands, agencies and production partners on your behalf.Likeness Rights
You retain ownership of your underlying likeness (face, voice, persona). By participating in the Programme you grant ROMAN SKY COLLECTIVE a non-exclusive, worldwide, transferable license to produce, display, promote, license and commercially exploit the AI avatar derived from that likeness for the duration of the agreement and for any bookings confirmed during that period. The avatar itself, as a generated work, remains under the production rights of ROMAN SKY COLLECTIVE for the duration of the representation.Submission Requirements
You agree to submit only materials in which you appear personally and to which you hold full rights. All submissions must be fully clothed. No nudity, no semi-nudity, and no sexually suggestive content of any kind will be accepted. Materials depicting third parties, copyrighted environments, branded clothing without rights, or minors will be rejected without refund.Eligibility and Identity
You confirm that you are 18 years of age or older and able to provide proof of identity on request. ROMAN SKY COLLECTIVE reserves the right to require identity verification before producing or releasing any avatar and to refuse or terminate any submission that cannot be verified.Biometric Data Consent (GDPR Article 9)
You explicitly consent to the processing of your biometric data — including facial features, body proportions and vocal characteristics — for the sole purpose of producing, refining, representing and commercially licensing your AI avatar within the Programme. This consent forms the legal basis for processing under Article 9(2)(a) of the General Data Protection Regulation. You may withdraw this consent at any time by written notice to ROMAN SKY COLLECTIVE, in which case your avatar will be removed from the roster and your biometric data deleted, subject to the booking obligations described under "Withdrawal and Deletion" below.Setup Fee, Refunds, and Right of Withdrawal
The setup fee corresponding to your selected tier is a one-time payment due upon acceptance of your application. You hold a statutory 14-day right of withdrawal under §312g BGB, which begins on the day the contract is concluded. If production of your avatar has not yet started, the setup fee is fully refundable within this period. If you expressly request that production begin within the 14-day window and acknowledge in writing that doing so terminates your right of withdrawal, the setup fee becomes non-refundable upon commencement of production. After production has begun, the setup fee is non-refundable in any case.Commission Structure
Once your avatar is live, you receive 80% of every confirmed paid booking arranged by ROMAN SKY COLLECTIVE. ROMAN SKY COLLECTIVE retains 20% to cover ongoing representation, pitching, production, contract administration and brand-safety operations. Payouts are made quarterly via SEPA transfer, subject to a minimum payout threshold of €50. This commission structure is distinct from the 10% commission applicable to creators who submit existing AI models for listing only.Booking Approvals and Veto Right
You retain a 48-hour veto right on any individual booking offer. If you do not respond to a booking notification within 48 hours, ROMAN SKY COLLECTIVE may proceed to confirm the booking on the agreed terms. You agree not to exercise the veto right unreasonably or in bad faith.Usage Restrictions
Your avatar will not be used, and you may not authorize its use, for: nudity or sexually explicit content; political endorsements or partisan campaigning; defamatory, hateful or harassing material; deceptive deepfake content presenting the avatar as a real, identifiable third person without that person's consent; medical, financial or legal endorsements that misrepresent qualifications; or any application unlawful under German or applicable EU law. ROMAN SKY COLLECTIVE applies brand-safety review to every brief and may decline bookings on these grounds without consultation.Withdrawal and Deletion
You may request deletion of your avatar at any time by written notice. Upon receipt, ROMAN SKY COLLECTIVE will remove your avatar from the active roster within 30 days. Bookings already confirmed and contractually committed before the deletion request must be honored to completion. Once deletion is finalized, all biometric reference materials and avatar production files will be permanently deleted, and no further bookings will be solicited.No Guarantee of Bookings
The setup fee secures your production work and your placement in the talent pool. ROMAN SKY COLLECTIVE makes no representation or warranty as to the volume, frequency or value of bookings. Booking outcomes depend on market demand, brand fit, and creative direction, and cannot be guaranteed.Indemnification (Programme-specific)
You confirm that all reference materials, persona descriptions and voice samples submitted are your own and free of third-party rights, and that no element of your submission is intended to replicate or impersonate any identifiable real person other than yourself. You agree to indemnify and hold harmless ROMAN SKY COLLECTIVE, ROMAN SKY MEDIA GROUP and their affiliates from any claim arising from a breach of these representations.Programme Attestation Text
